CANDIDATE PRIVACY POLICY

Dear visitor, before getting in contact with us, please consider our Candidate Privacy Policy regarding the processing of your personal data. Reading this you will understand how we collect your data, the purpose of processing, how we use it, who has access to it and all other important information concerning what you agree to share with us. 

This Policy informs about your privacy rights, which you can exercise as a data subject.

This applies to you and to all candidates who apply, are contacted, or referred for any opening generated by SMEDIX Inc.

About us

Using “we”, “us”, “ours”, “SMEDIX” – we refer to the company, its affiliates and subsidiaries.

“You” refers to you, as a data subject in the position of a website visitor, approached candidate or referred candidate.

One of our main goals is to protect your personal data since we are data controllers and are fully aware of the responsibility to secure a legally process and protect all data we use in our daily work. 

Processing your personal data

We are collecting any personal data you are sharing with us, as a candidate or as a referred candidate, for the purpose of interviewing, as part of our recruitment process. This data is directly sent by you and we are protecting it from all unentitled parties. 

How do we process your data? 

  • You apply to our openings by filling the “contact us” questionnaire on our website.
  • You apply to our openings by sending an e-mail to anyone from our organization who will, immediately, notice HR Department.
  • You apply to our openings by sending an e-mail directly to HR Department representatives.
  • You apply to our job postings on LinkedIn.
  • You apply through a friend, process also know as internal referral, in which case your application will be processed as per our internal referral procedure.
  • We contact you through professional recruitment platforms especially designed for the purpose of recruitment and selection.

Whenever you submit your application (with or without a CV/Resume) it is likely that other data related to you will be obtained during interviews (including public sources or third parties), in accordance with legal requirements.

Please take into consideration to include in your CV/Resume only relevant personal data, mainly such as identification and contact personal data, job history, qualifications, education, relevant achievements etc.

SMEDIX will only process your personal data for the recruitment purpose, with the following additions:

  • Recruitment process may include communication with the candidate, evaluation and/or verification of CVs and references, interviews, and assessments.
  • If the recruitment process is successful and the candidate is hired, the data will be used later in the Onboarding process.
  • If the job application is rejected (unsuccessful candidates), we will keep your CV/Resume for a limited period. Why? To notify you about other available job opportunities in SMEDIX, or to exercise our right of defense in case of legal action or complaints against us; Remember that you can always object to this and inform us.
  • We collect and process the following categories of personal data and other data from the evaluation process, such as:
  • Identification and contact details: name, surname, phone, address, email
  • Different personal data contained in CV/Resume, provided by you, such as birthplace, nationality, gender, etc.
  • Sensitive personal data, such as health data (but only to adjust the recruitment process if needed or to conclude with the hiring plan).
  • Data related to professional life: previous jobs, employers, occupations, desired jobs, career

prospects, desired salary, and so on.

  • Data related to your education such as studies, qualifications, educational experiences, and references from universities, professors and so on.
  • Data related to the evaluation of candidates (including interview notes, screening, previous data held, as appropriate)
  • Data about criminal records

Important: The legal basis for the processing of personal data is our legitimate interest (by ensuring that our actions do not prevail over your rights and freedoms), your consent (where applicable), and / or the execution of the contract (regarding the processing operations carried out before the closing of the employment contract).

Retention of personal data

We will keep your personal data within a limited time frame of maximum five years, in accordance with our internal policies and applicable law and we might contact you for other job opportunities meanwhile. At the end of this period your data will be deleted.

If at some point, during the five years, you enroll in another recruitment process for another job opportunity, you apply for another job opportunity (directly or referred by a colleague) or you send updates regarding your CV/Resume or professional motivation for accuracy reasons, we will restart the time frame and your data will be kept for five years starting with the last official change.

If, at any point, you want us to delete any or all the data we have of you, please inform us, by sending us an email to: in@smedix.com and we will proceed accordingly.

Disclosure of personal data to third parties

We may disclose your personal data to third parties if this is necessary to develop our activities and for reasons related to our legitimate interest.

We may also disclose your personal data, when this is necessary or to fulfill a legal requirement, to:

  • Authorities
  • Public institutions
  • Attorneys
  • Insurance companies
  • Auditors
  • External consultants 
  • Suppliers
  • Clients

There might be situations when we disclose your data to protect your vital interest or the vital interest of another person. We may also act similarly whenever necessary for the establishment, exercise, or defense of legal claims.

Internationals transfer of personal data

Independently of the third parties’ location, we will make sure that the personal data security is maintained (minimized and controlled access) and the data transfer (including our teams and clients in US and outside of the EU where applicable) complies to the international privacy legislation (e.g., adequacy decisions, standard contract clauses, Privacy Shield).

Personal data security

We are accountable for protecting your personal data (collected directly or indirectly from you), therefore we are continuously focusing on the optimal functioning of our IT systems and all implemented technical controls, part of our information security management system. Only authorized personnel have access to your personal data, such as HR and Recruitment.

Your rights

You can exercise certain rights as a candidate, and we will respond according to all the applicable legal requirements. It is important to say that some rights we will state below may apply only partially or under certain specific circumstances.

  • To have access to your personal data that we might have (you can request directly what data we keep)
  • To rectify or update your personal data (please contact us if you notice that your personal data is incorrect or if you want to update your CV/Resume, or you can correct/update it yourself by sending us an email)
  • To erase any personal data
  • To restrict and / or object the way we process your personal data
  • Data portability (supply the data in transferrable format)
  • To withdraw consent, whenever the consent was given
  • To not be a subject to automated decisions and profiling, which produce legal or significant effect in our recruitment processes.
  • The right to complain to the supervisory authority

We may update this Policy form whenever we find it necessary and publish a renewed revision on this site. Therefore, we invite you to read this Policy regularly.
